1. About Us

   BuyAnyCar.com is a platform (hereinafter referred to as “Site”) operated by SellAnyCar.com FZE, registered in Sharjah Airport International Free Zone under license number 12076. The registered address is in Sharjah, United Arab Emirates.

   In this PP, the terms “SellAnyCar,” “BuyAnyCar,” "Carnab," "Kayishha," "SellAnyCar.com Dealer Portal," "Kayishha Dealer Portal," and "Tojar by Kayishha," as well as “we,” “us,” and “our,” refer to our group of companies (hereinafter referred to as “GOC”). The terms “you” and “your” refer to you as a user of our websites, mobile, digital properties and other online applications, products, and services (collectively, the “Services”).

   Depending on the commercial and professional activities you are choosing, you may interact with one or more of our GOC that include SellAnyCar.com FZE as mentioned above and the entities listed in our Terms and Conditions as defined as part of our GOC.

   By using our Site and Services, you agree to the terms and conditions of this PP.

2. Service Territory and General Notice

   1. Our Service Territory is the United Arab Emirates (UAE). Access to our Site is restricted to users within the Gulf Cooperation Council (GCC) countries. Products or services offered on our Site are not available for purchase by users outside the GCC, and exports outside the Service Territory are rarely accommodated.

      It has come to our attention that numerous residents within our Service Territory and the GCC still maintain mobile app store regional settings corresponding to countries from which they have immigrated. We acknowledge the inconvenience associated with altering app store region settings, particularly for the general public. However, it is important to note that enabling downloads of our applications from mobile app stores outside our Service Territory does not signify extension of our Services to those regions. Our Service Territory and the GCC are home to a significant expatriate population, and as such, our Services are tailored to meet the needs of residents within our Service Territory.

   2. International Use and Transfer. We may employ measures to block IP addresses from outside the GCC to prevent account creation and submission of Registration Data, as defined in our Terms and Conditions. However, system errors, unblocking decisions or circumvention techniques (e.g., via VPNs) may result in Registration Data or User Information being transmitted to us from outside the GCC. In such instances, we disclaim any liability for such occurrences. We are based in the UAE, and the information we collect is governed by UAE law. If you are accessing our Site and Services (or generally our digital properties) from outside of the UAE, please be aware that information collected may be transferred to, processed, stored, and used in the UAE and other jurisdictions. Data protection laws in the UAE and other jurisdictions may be different from those of your country of residence. Your use of this Site and Services, and generally our digital properties, or the provision of any information, therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in the UAE and other jurisdictions as set out in this PP.

   3. EU, US and Canada Residents. Residents of the European Union (EU), the United States of America (US) and Canada are expressly prohibited from visiting our Site or registering an account with us, as our PP has not been designed according to GDPR, US or Canadian requirements.

   4. General Notice. Should you not comprehend or have any uncertainties regarding our PP, we strongly advise you to seek counsel from a legal advisor prior to using our Site and Services.

3. Information we collect

   1. We take appropriate steps to ensure data privacy and security, including through various hardware and software methodologies. However, we cannot guarantee the security of any information that is disclosed online.

   2. We may provide aggregate statistics and other information about our customers, sales, traffic patterns, and related site data to third-party vendors and other entities. Additionally, we may share your User Information with third parties for any purposes we deem appropriate, including but not limited to fraud prevention, risk management, dispute resolution, and various commercial activities.

   3. You grant to us and our affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform any video, audio, digital communication, or other interactions you have with us throughout the universe in any media, now known or hereafter devised. We reserve the right to record, store, edit, distribute, and otherwise use such interactions in any form or medium.

   4. Cameras installed in private and public places. You consent to the collection of data, including but not limited to User Information, vehicle information, license plate numbers, and personal data, through the operation of cameras installed in private and public places. This data may be used for the purpose of controlling gate barriers and facilitating passage, and will be handled in accordance with this PP.

   5. We may utilize your User Information to send you marketing materials, such as newsletters or general messages, or to contact you via calls, as part of our efforts to enhance our customer relationship management.

   6. Your personal data shall be held and utilized, with strict confidentiality maintained, and shall not be disclosed to any unauthorized individual or entity. When deemed appropriate, we may employ such information in conducting marketing endeavors, research initiatives, or any other activities as we deem necessary, including the enhancement of features in our products and services.

   7. We may share your User Information with selected vendors and business partners with whom we work. This includes companies that offer affinity, frequent-user, and reward programs; companies that perform marketing services and other business operations not limited in its nature; and companies that assist us with data analysis, customer service, and promotional activities.

   8. We may disclose your User Information we collect from you if required to do so by law or in the good-faith belief that disclosure is necessary:

      1. to obey the law or comply with legal process served on us or our affiliates;

      2. to protect and defend our rights or property or the rights or property of other users of our Site;

      3. to act in an emergency to protect the personal safety of users of our Site or the public;

      4. to facilitate a business transfer, such as a merger or acquisition;

      5. in connection with any legal proceedings or prospective legal proceedings; or

      6. in circumstances where we ascertain certain information to be non-sensitive, including data from your User Information, we reserve the right to disclose it, including as part of ordinary course business activities or as integral components of our Services.

   9. All credit/debit card details and personally identifiable information submitted by you for payment purposes directly to our payment provider shall remain under the responsibility of said payment provider, as we do not retain such information.

   10. Some of the advertisements you see on the Site are selected and delivered by third parties, such as ad networks, advertising agencies, advertisers, and audience segment providers. These third parties may collect information about you and your online activities, either on the Site or on other websites, through cookies, web beacons, and other technologies in an effort to understand your interests and deliver to you advertisements that are tailored to your interests. Please remember that we do not have access to, or control over, the information these third parties may collect. The information practices of these third parties are not covered by this PP.

   11. Your User Information may be shared with general users of our Site, buyers, sellers, dealers, manufacturers, their agents, and third-party service providers, who will use that information in accordance with their own privacy policies. The following are merely examples and not limitations:

       1. If you are interested in a particular car listing, your User Information may be shared with the buyer or seller of that car, or with dealers of similar cars in your area, such as when you submit a lead request or enter into a chat with the buyer or seller;

       2. If you are considering trading in a car, we may provide your User Information to dealers who offer trade-ins, as well as to other dealers, buyers, and sellers;

       3. We may provide manufacturers, their agents, or third-party service providers with your User Information;

       4. We may provide manufacturers, their agents, or third-party service providers with your User Information if you are interested in certified pre-owned vehicles; or

       5. We may provide manufacturers, their agents, third-party service providers, and dealers with your User Information when you access our Site via advertising or functionality found on their websites or other third-party websites and digital properties.

   12. Loan Applications. If you apply for credit on our Site with us, our dealers, or any third party, it will be necessary for you to provide personal information to complete the application, including your address, credit information and history, employment and other financial information. We may share your application information with the dealership(s) you selected and our financial partners so that they can process your application and otherwise use it in accordance with their privacy policies.

   13. We may drop cookies on your computer after visiting our Site and/or digital properties, to deliver personalized adverts while you browse the internet. Additionally, we may use cookies to track your browsing behavior, preferences, and other data to enhance your experience on our Site and for targeted advertising purposes.

       1. What are cookies? Like the majority of sites on the internet our Site and digital properties use cookies. We collect internet log information and details of visitor behavior patterns through the use of these cookies when you visit our Site and/or digital properties. We do also have relationships with monitored third party suppliers that may also set cookies during your visit to be used for remarketing purposes.

Based on this anonymous information we are then able to note the areas that may need improving and thereby improve your satisfaction with our website.

We reserve the right to participate in, monitor, and/or block such communications, in whole or in part, at our discretion. This policy applies to communications conducted on our Site, as well as through third-party applications, such as WhatsApp or other platforms that we utilize. By providing a mobile phone number, you consent to receive calls or text messages at that number, whether manually or automatically dialed, from us and from other entities authorized by us.

   15. We may collect an array of personal information falling within the following categories, though not limited to these:

       1. Registration Information: Upon creation of an account or subscription to any of our Services, we may procure details such as your first and last name, country of residence, phone number, vehicle and license plata data, email address, username, login credentials and password.

       2. Transaction Information: Pertinent data processed during your interaction with our Services on our Site and/or digital properties may encompass your postal address, telephone number, and payment particulars.

       3. User Activity Information: This category may encompass insights into your and any authorized person(s) under your account's utilization of our Site and/or digital properties, including but not limited to the content accessed or posted, frequency of service usage, and preferences. Additionally, it may comprise information shared in public forums hosted on our Site and/or digital properties, such as forum posts or blog comments, along with data exchanged via messaging chats or analogous services, both on our Site and/or digital properties and third-party applications.

       4. Third-Party Information: Insights regarding the usage of our Site and digital properties, whether directly hosted by us or on third-party platforms or devices, constitute this category.

       5. Location Information: Location data, sourced from mobile or other devices interacting with our Site and/or digital platforms (inclusive of beacon technologies), or associated with your IP address, may be acquired.

       6.    16. Publicly posted information.

       1. Your member profile will be publicly viewable and identifiable. Please consider carefully before making any information public as you are solely responsible for any information you make public. Once you have posted information, you may not be able to edit or delete it.

       2. If you choose to communicate with another user, you may be contacted by other users through us as an intermediary.

       3. Information that you make available to us and/or others via social media networks, forums, blogs, lists, chat rooms, or similar functionality is considered public information. We or others may share or use this information.

       4. We reserve the right to publicly publish user data, including but not limited to User Information, user behavior, activities, profile views, messages, and any other interactions made on our digital properties, Site or Services.

   17. Use of User Information for AI and Machine Learning.

       By using our Site and Services, you acknowledge and agree that we may collect, process, analyze, and utilize User Information, including but not limited to personal data, browsing behavior, transactional history, and communication exchanges with us or any third party, to train and improve artificial intelligence (AI) systems, machine learning algorithms, and other data-driven models. This includes, but is not limited to: enhancing customer support and personalization, improving fraud detection and security monitoring, developing operational insights, conducting research for service enhancements, creating predictive analytics, general commercial exploitation, and optimizing user experiences.

   18. Image Recognition, Scanning & Uploads Feature.

       We have introduced a feature (among others branded as “Scan Any Car,” “Scan,” “Upload Image,” “Upload Video,”etc.) that enables users to scan, photograph, or upload images, videos, or other visual content of vehicles, license plates, or any related objects using our mobile applications or digital properties. By using this feature, you hereby acknowledge, agree to, and represent the following:

       i. Data Ownership and Transfer of Rights: You confirm that you have the full right, license, or necessary consents to upload, scan, or otherwise transmit such content to us, and you irrevocably assign, transfer, and grant us and our group of companies (GOC) all worldwide rights, title, and interest, including intellectual property rights, in such uploaded content. This includes any data, imagery, metadata, and associated information derived or generated from such uploads.

       ii. License to Use and Commercialize: You grant us an unrestricted, worldwide, irrevocable, royalty-free, perpetual, transferable, and fully sub-licensable right to use, reproduce, store, process, analyze, commercialize, monetize, modify, adapt, publish, translate, create derivative works of, publicly perform, display, and otherwise exploit such content for any purpose, including database enhancement, public listings, resale, advertising, and any commercial usage.

       iii. Use for AI and Machine Learning: You expressly agree and acknowledge that all uploaded content, including images, scans, and associated metadata, may be used by us and our affiliates to train, test, develop, and enhance artificial intelligence (AI) models, machine learning systems, computer vision algorithms, and other automated data-processing technologies. This usage may include integration into large-scale datasets used to improve our platforms, services, and products across all digital and offline properties.

       iv. Compliance with Laws: You are solely responsible for ensuring that any uploaded images, scans, or data comply with all applicable laws and regulations, including data protection, privacy, copyright, and intellectual property laws. You must not upload or transmit any content that violates any third-party rights or applicable laws.

       v. Sensitive and Personal Data: Certain features of our Services may require you to upload official documents that contain sensitive personal data, such as car registration cards, driver's licenses, national ID numbers, passport details, or other government-issued identification. By using such features and uploading these documents, you confirm that you are authorized to provide this information and that you have obtained all legally required consents where applicable. You expressly consent to our collection, storage, processing, analysis, publication (where relevant), and commercialization of this data in accordance with this Privacy Policy. You acknowledge and agree that this data may also be used to enhance our services, support identity verification, prevent fraud, improve operational processes, and for AI training and development purposes.

       vi. Automated Processing and Publication: You acknowledge and agree that all uploaded content may be automatically processed, analyzed, displayed, or published on our platforms or partner services, and used to enhance listings, analytics, and various features within our services.

       vii. Indemnity: You agree to fully indemnify and hold harmless our group of companies, affiliates, directors, employees, and service providers from any claims, liabilities, damages, or losses arising out of your use of this feature, including but not limited to any violations of applicable law or third-party rights.

        

4. How we collect information

   The following describes various methods through which we may collect your User Information, either directly from you or automatically during interactions with our Site and/or digital properties. Please note that this is not an exhaustive list and other means of collection may also be employed.

   1. User Information you share directly

      1. When requesting to be contacted by or contacting a buyer or seller.
         If you request to be contacted by or contact a buyer or seller, both us and the buyer/seller may collect User Information provided by you through the text, chat or voice functionalities that we or third-parties provide.

      2. When using our Site to buy or sell a product or service.
         If you want to use our Services to buy or sell a product or service, we and/or our business partners may collect information provided by you in connection with that transaction, for example to create your Listing, to verify vehicle or license plate ownership, to confirm funds availability, to process payment, to populate purchase and sale documents, and to provide user support. We may collect this information from entry forms on our Site or third-party sites we integrate with, or from a picture of your ID that you upload. This information may, among others, include your full name, address, email address, telephone number, driver's license number, photo, gender, date of birth, vehicle identification number, traffic file code, bank name, and bank account and routing numbers.

      3. When registering with us.
         If you register with us or subscribe to receive specific information or services on our Site, we will also collect User Information, Registration Data.

   2. Automatic collection of User Information

      1. In addition to the User Information we may collect from you directly, we also collect data from your browser or device using tracking technologies. We automatically collect certain browser or device technical data in order to deliver our services to you, and to help make sure our Site and digital properties are functioning properly. This typically includes data about your browser or device's IP address, user agent string, your internet service provider or mobile carrier and the type of handheld or mobile device you use.

      2. Along with companies we partner with, we employ pixel tags, cookies, java scripts, SDKs, local shared objects such as Flash (sometimes called “flash cookies”), and similar technology (“tracking technologies”) on our Site and digital properties, and third-party digital properties we integrate with.    3. Other ways User Information is collected

      1. Applications and widgets for social media.
         We may display applications or widgets from social media providers that allow interaction or content sharing by their users. These widgets, such as the Facebook "Share" or "Like" button, are visible to you on the page that you visit. This may allow the social media networks in which you participate to collect information about you, even when you do not explicitly activate the network's application or widget while on our Site or digital property. Please visit the applicable social media network's privacy policy to better understand their data collection practices and the choices they make available to you.

      2. In addition to social media networks, our Site and digital properties also contain references and links to third-party sites that may offer information of interest. This PP does not apply to those sites, and we recommend reviewing those sites' privacy policies individually.

      3. Information collected from other sources.
         We may process User Information from third-party sources to update or supplement the information that you provide or that we collect. For instance, we may collect vehicle registration information from public databases to support a service you have engaged us for. Other sources of information include third-party advertising partners, data providers or aggregators, and search information providers. We use this information to help us maintain the accuracy of the information we collect, personalize your experience with the site, target our communications and advertisements so that we can inform you of products and services or other offers that may be of interest to you, provide private purchase and sale transaction services, prevent fraud, and for internal business analysis or other business purposes.

5. Consent to processing globally

   By providing any User Information to us, you, including, without limitation, users in the Service Territory or GCC or globally, fully understand and unambiguously consent to this PP and to the transfer of such User Information across international borders in accordance with our standard operations, including the collection, storage, and processing of such information globally. You also consent to the processing of your User Information for the training and development of AI, machine learning, and similar data-driven technologies, as described in this PP.

6. Changes to this Privacy Policy

   We may occasionally update this PP to reflect changes in our practices. When we post modifications to this PP, we will revise the "Last Updated" date. The modified PP will be effective immediately upon posting. Your continued use of our Site and/or digital properties after the posting of the modified PP constitutes your agreement to abide and be bound by it. We encourage you to periodically review this page for the latest information on our privacy practices.
